One group is immigrants who have been convicted of aggravated felonies, who are barred from seeking discretionary relief under former President George W. Bush’s 2007 Pro-Criminal Alien Control Policy. The other is immigrants who were brought to the U.S. as children and who have not been convicted of any crimes. Those two groups are currently treated differently. Immigrants who have been convicted of aggravated felonies are treated in the same way as other criminal aliens: they are deported. In contrast, the fate of immigrants who have been placed in the “unlawful presence” category is determined by a kind of administrative catch-and-release policy that the Obama administration adopted in 2012. Under that policy, illegal immigrants are not sent home to await removal but are instead given “deferred action” status. The Obama administration characterizes this as an administrative loophole that provides a long-term reprieve from deportation. That may seem like a common-sense approach. But as the case of Sergio Martinez Ramos illustrates, the system is more complicated than that. Ramos is a gay native of Colombia who immigrated to the U.S. as a child. While working as a bus boy, he was arrested and convicted of a felony for having sex with his male partner. Ramos was deported in 2004 after serving out his prison sentence. It took five years for Ramos to get his green card. When he applied for a renewed green card, the Department of Homeland Security (DHS) didn’t give him a break on the previous felony and applied the “unlawful presence” clause of the immigration law, which provides for deportation if an immigrant is in the U.S. without permission.
